Terms of Service

These Terms of Service ("Terms") govern your use of Vocado, a macOS dictation application provided by Vision Forge Studios ("we", "us", "our"). By downloading, installing, or using Vocado, you agree to these Terms.

1. The Service

Vocado is a dictation application that converts speech to text using cloud-based transcription. The service requires an internet connection to function.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase a subscription. You may use Vocado if you are at least 13 years old, provided a parent or guardian agrees to these Terms on your behalf.

3. Free Trial

Vocado offers a 7-day free trial. The trial begins when you first launch the application and is limited to 50 transcriptions per day. No credit card is required to start the trial. At the end of the trial period, you must purchase a subscription to continue using Vocado.

4. Subscription and Payment

Pricing

Vocado is available for $4.99 USD per month. Prices may vary by region and are subject to change with notice.

Billing

Subscriptions are billed monthly through Paddle, our payment processor and Merchant of Record. Paddle handles all payment processing, invoicing, and sales tax/VAT compliance. Your subscription will automatically renew each month until cancelled.

Payment Methods

Paddle accepts major credit cards, PayPal, and other regional payment methods. We do not receive or store your payment card details.

5. Cancellation and Refunds

Cancellation

You may cancel your subscription at any time through your Paddle account. Upon cancellation, you will retain access to Vocado until the end of your current billing period. No partial refunds are provided for unused time within a billing period.

Refund Policy

We offer a 14-day money-back guarantee on your first payment. If Vocado doesn't meet your needs, contact us within 14 days of your first payment for a full refund, no questions asked.

For subscription renewals, if you were charged in error or forgot to cancel, contact us within 48 hours of the renewal charge for a full refund.

Refund requests should be sent to support@vocado.talk or processed through Paddle's customer support.

6. Licence Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use Vocado on macOS devices that you own or control, for personal or business use.

You may not:

Reverse engineer, decompile, or disassemble Vocado
Modify, adapt, or create derivative works based on Vocado
Rent, lease, lend, sell, or sublicense Vocado
Remove or alter any proprietary notices or labels
Use Vocado for any unlawful purpose

7. Acceptable Use

You agree not to use Vocado to:

Transcribe content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
Violate any applicable laws or regulations
Infringe on the intellectual property rights of others
Attempt to gain unauthorised access to our systems or services
Interfere with or disrupt the service

8. Intellectual Property

Vocado, including its design, features, and content, is owned by Vision Forge Studios and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.

Your transcription content belongs to you. We claim no ownership over text generated from your speech.

9. Third-Party Services

Vocado relies on third-party services for transcription (Groq, OpenAI), payment processing (Paddle), and error reporting (Sentry). Your use of Vocado is also subject to the terms and policies of these providers. We are not responsible for the practices of third-party services.

10. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

11. Disclaimer of Warranties

VOCADO IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

Vocado will meet your specific requirements
Vocado will be uninterrupted, timely, secure, or error-free
Transcription results will be accurate or complete
Any errors will be corrected

Transcription accuracy depends on audio quality, background noise, accent, and other factors. You are responsible for reviewing and verifying all transcribed text.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VISION FORGE STUDIOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your use or inability to use Vocado
Any errors or inaccuracies in transcription
Unauthorised access to or alteration of your data
Any third-party conduct or content

Our total liability for any claims arising from these Terms or your use of Vocado shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Vision Forge Studios, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of Vocado or violation of these Terms.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on our website and updating the revision date. Your continued use of Vocado after changes become effective constitutes acceptance of the revised Terms.

15. Termination

We may suspend or terminate your access to Vocado at any time, with or without cause, with or without notice. Upon termination, your licence to use Vocado ends immediately. Provisions that by their nature should survive termination will survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Vision Forge Studios regarding Vocado and supersede any prior agreements.
